Supreme Court Heard Arguments on Trump’s Birthright Citizenship Proposal

The U.S. Supreme Court heard arguments on whether lower courts have the authority to issue nationwide injunctions blocking President Donald Trump’s executive order, which seeks to end automatic birthright citizenship for children born in the U.S. to parents who are illegally or temporarily present. Solicitor General D. John Sauer defended the administration’s position, while New Jersey Solicitor General Jeremy Feigenbaum represented over a dozen states challenging the injunctions’ scope. The Court is not evaluating the order’s constitutionality but rather whether courts can indefinitely halt its enforcement with universal injunctions, a practice that has blocked the order since lower courts issued preliminary injunctions. Justices Amy Coney Barrett and Brett Kavanaugh pressed Sauer on logistical challenges, such as how hospitals and states would implement the order, while others questioned the implications of limiting nationwide injunctions and forcing individual lawsuits.
